E-mail spamming, spamming of URLs,
using of unauthorized copyrighted materials (such as warez, photos &
movies), and posting of illegal content (such as a child pornography, bestiality,
offensive material) are grounds for termination, will be reported to law
enforcement, and all services will be stopped.
2. PRICES, INVOICING, REFUNDING AND PENALTIES
2.1 All Digidotz Networks Accounts
are monthly accounts and are prepaid. Charges for new accounts are prorated
to accommodate the billing cycle. The billing cycle runs from the first
of the month to the last day of the month. Charges for terminating accounts
are not prorated.
2.2 Ekstra bandwidth and space fees
must be paid before the bandwidth or space can be add to your account.
2.3 If customer burn all prepaid
bandwidth and doesn't pay for next amount of bandwidth, all provided services
will be stopped and will run again after paying or the 1. of the following
2.4 Digidotz Networks may terminate
any account with no refund to customer in the event of customer's breach
of any of the terms or conditions contained herein. Delinquent accounts
are those that remain unpaid at the beginning of the next accounting cycle,
and are subject to a 2% per month service charge (24 % per annum). Accounts
that are delinquent for more than seven (7) days are put on "accounting hold/account suspended",
their files are then archived and access is denied. Digidotz Networks accounts
continue to accrue charges while they are on hold. Accounts that are unpaid
for thirty (30) days after due date have their files purged.
Digidotz can at any time cancel your account within a 30 days warning.
2.6 Digidotz offers a 30 day money back guarantee. After that period, payment stop when client cancel the hosting account. If client cancel the hosting account before the end of payment period, we dont refund the payment for the existing month but payment will be stopped before next payment.
2.7 Right after we have received your order/payment you will receive a confirmation email of your order.
3. SERVICES AND SUPPORT
3.1 Digidotz guarantee that the
Digidotz's network will be available 99% of the time in a given month,
excluding scheduled maintenance. Network uptime includes functioning of
all network infrastructure including routers, switches and cabling. Network
uptime does not include HTTP server error, software e.g., server specific problems e.g. disk check or reboots.
If your site isn't up 99% in any one month we will issue a full refund for the month. Digidotz do not cover for any loss of money in any giving downtime.
3.2 Any technical issues regarding
problems with account setup, server software problems, or any other problems
that are directly connected with Digidotz services will be corrected free
of charge. Technical problems are solved up to 24 hours, more difficult
problems (e.g. DNS problems) are solved up to 72 hours. Additional technical
support such as the setting up of customer's scripts or software, and/or
programming of any scripts/applications will be billed per arranged hour
3.3 Support tickets requests and emails sent to http://www.sprintserve.net/support.php are answered by priority, and by the order in which they are received. While we aim to respond as quickly as possible, however it may take 1-2 hours to reply during unusually busy periods.
4. COMPLIANCE WITH LAWS
4.1 E-mail spamming, spamming of
URLs, using of unauthorized copyrighted materials (such as warez), and
posting of illegal content (such as a child pornography, bestiality, offensive
material) are grounds for termination, will be reported to law enforcement,
and all services will be stopped. In this case, Digidotz can terminate
this agreement and remove all of customer's equipment from the facility
and store the same at customer's expense.
4.2 CUSTOMER IS FULLY RESPONSIBLE
FOR ANY CONTENT WHICH HE/SHE PLACE ON HIS/HER WEB SITE OR IN HIS/HER DIRECTORY ON DIGIDOTZ'
SERVERS. IF CHILD'S PORN, BESTIALITY, WAREZ OR UNCOPYRIGHTED MATERIAL WILL
BE FOUND, ACCOUNT WILL BE TERMINATED IMMEDIATELY.
DIGIDITZ CAN NOT BE HOLD RESPONSIBLE OF ANY KIND FOR WHAT THE COSTUMERS/USER HAVE ON THERE WEB SITE OR IN THERE DIRECTORY.
5. OBLIGATIONS OF EITHER SIDES
5.1 Digidotz is obliged not to
provide any information about the customer to the third side, and these
data will use just for own purposes. If any information about customer
will be given to public, it will be done with the customer's agreement
5.2 Customer is obliged pay for all
provided services at time. Customer is also obliged don't publish illegal
material of any type as is mentioned above.
